Article 14 – Section 1:

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

I was driving into work this morning and on the radio was a discussion about how some child born to parents that are here in the U.S. illegally was suing the state of Florida because she was going to have to pay out of state tuition to go to college in Florida due to her parents being unable to produce proof of legal status to be here. More have joined her in the suit.

This is the problem with the court system today. Too many times judges recite the letter of the law the exactly as it is written when it fits their beliefs and then proceeds to interpret the law when as the law is written does not fit their beliefs.

Brief Sidebar – Some of you may now be reflecting back on my position regarding Texas and in-state tuition for the children of illegals in that state. My main argument was that it was a state issue and the state of Texas did what it thought best for the state of Texas. I supported their decision because they were pro-active instead of being completely inactive like the federal government. – Sidebar is now over.

I’m sure the parents can prove they have resided in the state of Florida for the required amount of time but if you are here illegally then if the state believes you should have no rights, then by all means I support the state. If the state wants grant you certain rights specific to that state including having your anchor babies pay in state tuition, then again I support the state. It’s a STATE issue.

The 14th amendment to the constitution came about because of slavery. Since many slaves were brought to this country against their will, once slavery ended, their children should by all means be lawful citizens of this country. It was a way to protect the kids of former slaves.

The law now is being taken in a complete different text than it was meant to be when drafted and ratified. In my own opinion, the U.S. should grandfather the kids of illegals as citizens but say as of 01 JAN 2012, the law changes to where children of illegals do not have the right to become lawful citizens of the United States simply by being born here.

In my opinion the law covering anchor babies make as much sense a bank robber who steals several thousands of dollars, files taxes on the stolen money then gets to keep what is left because even though he gained it illegally, he paid taxes on it therefore he is “entitled” to it. It makes no sense.

The host of the morning talk show stated the subject of anchor babies is a complicated issue. I think we need an amendment to the 14th amendment, NO MORE ANCHOR BABIES. It’s not complicated to me.
